These terms apply to any services you require from our website. Please read them carefully before you submit any information onto our website, as they set out important information about your and our rights and obligations.

Providing services

  2. We will provide the services at the time(s) and on the date(s) selected by you or within the period agreed with you during the quotation process.
  3. We will do all that we reasonably can to provide the services at the time(s) and date(s) or within the period agreed with you. If there might be a delay before we can start or restart the services, we will email you to let you know as soon as reasonably possible. However, we are not liable to you for any losses you incur as a result of any delay caused by circumstances beyond our reasonable control (for example, severe weather, accidents or unpredictable traffic delays).
  4. We are not liable to you for any losses you incur where the services are delayed or cannot be performed because you fail to provide us with adequate instructions or information to allow us to perform the services.
  5. The services are provided to you for your domestic and personal use only. You must not use our services for commercial or business purposes.
  6. We do not provide financial, investment or other advice in relation to the services nor do we provide a recommendation or endorsement of the medical providers.

Faulty services

  1. We must provide the services to you with reasonable care and skill.
  2. If a service carried out by Mediglobe Ltd is not carried out with reasonable care and skill, you can ask us to repeat the service or to fix it. We are not responsible for any fault services carried out by a provider.
  3. If there is a problem with a service we have provided to you, please contact us as soon as reasonably possible.

Events beyond our control

We are not liable to you if we fail to comply with these terms because of circumstances beyond our reasonable control.

Your Responsibilities

  1. We will seek quotations based on the information you have provided to us. Where we ask questions to help source quotations, you are responsible for answering all questions honestly, completely and to the best of your knowledge, and for ensuring that any assumptions made are correct. Failure to do so may lead to your quotation being invalid or an increase in cost.
  2. Before purchasing a service it is extremely important that all the information the medical provider holds on you is accurate. You should therefore ensure that all information you provide to us is complete and accurate. Neither we nor any medical providers will check this information for you. Again, failure to do this may lead to your quotation being invalid or an increase in the cost.
  3. It is important that you read the medical provider’s terms and conditions to check that you understand and agree with them. The medical provider’s terms and conditions are not the same as ours and they will be additional terms you agree to when you accept a quotation.
  4. It is important that you read all documents issued to you and ensure that you are aware of the terms that apply.
  5. If the information supplied by you is not correct, it is your responsibility to notify both us and the medical provider.
  6. It is your sole responsibility to ensure that the treatments match your requirements.
  7. It is your responsibility to provide copies of your passport and travel documents to facilitate the booking of appointments with your chosen provider hospital.

Our responsibility to you

  1. If we breach these terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time the contract was made, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).
  2. We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
  3. All fees quoted are estimated fees and actual costs may vary. We are not responsible for the difference between any estimated fees and actual costs incurred.
  4. Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.

We are not responsible for

  1. any reliance that you may place on any material or commentary posted on our website. Please note that nothing contained in our website or the material published on it is intended to amount to advice on which you should rely; or
  2. any losses you suffer because the information you put into our website is inaccurate or incomplete
  3. any losses you suffer because any other information you provide to us is inaccurate or incomplete; or
  4. any losses you suffer if the information you put into our website is accurate but the medical provider’s website has not accurately reflected that information because its system is not working correctly; or
  5. any losses you suffer if you misrepresent any fact which may influence the medical provider’s decision to provide services; or
  6. any losses you suffer because you cannot use our website at any time; or
  7. any losses you suffer through connecting to any linked third party websites or any statements, information, content, products or services that are published on, or may be accessible from, any linked third party website and we do not guarantee that they are free from viruses or anything else that could be infectious or destructive; or
  8. any errors in or omissions from our website; or
  9. any losses you may suffer by relying on any commentary, postings or reviews (of our services or that of our partners) on our website; or
  10. any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it; or

How we are paid

  1. You will not be charged for using our website. Instead, when you use our website and buy a service from a third party, that third party pays a commission to us.
  2. Notwithstanding clause 11.1 there may be occasions where you are asked to pay the estimated cost of your treatment to us. In such cases we will transfer payment to the provider and you may be charged an administration fee. This administration fee will be communicated to you prior to payment.
  3. You may be charged for additional services that you request from us or from the provider. You will be advised fully of such costs and fees before you are charged for them.
  4. You may be required to make deposit or up-front payments to either us or the provider with any balance due at the end of the procedure payable.to the provider. If the actual costs are less than the upfront payment then the provider is liable to reimburse you at the time of discharge.
  5. The default currency for all prices/quotes/costs/payments is Euros although US Dollars and GB Pound Sterling is accepted by most providers. You will be asked to confirm which currency you will be using when the appointments are booked with providers. Any currency conversions will be done by the providers on the day of payment.

No third party rights

No one other than us or you has any right to enforce any of these terms.

Transfer of rights

  1. We may transfer our rights under these terms to another business without your consent, but we will notify you of the transfer and make sure that your rights are not adversely affected as a result.
  2. You are not allowed to transfer your rights under these terms to anyone without our prior written consent.

Governing law and jurisdiction

  1. The laws of England and Wales apply to these terms, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
  2. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
